Our Standard Real Estate Terms and Conditions:
 

 

Procedure: There will be no minimum starting bid on any property that is a part of this sale. The property will be offered in individual parcels. There will be open bidding on all parcels, during the auction as determined by the Auctioneer & bids on parcels may compete. All bids are subject to the Trustee's/Seller's acceptance or rejection.

 

Down Payment: 10% down payment the day of the auction with the balance in cash at closing. The down payment may be made in the form of cash, cashier’s check, personal check or corporate check. Your bidding is not conditional upon financing, so be sure you have arranged financing, if needed, and be capable of paying cash at closing.

 

Acceptance of Bid Prices: All successful bidders will be required to enter into purchase agreements at the auction site immediately following the close of the auction. All final bids are subject to the Trustee's/Seller's acceptance or rejection within 48 hours.

 

Title Insurance: Trustee's/Seller's will provide an Owner’s Title Ins. Policy with standard exceptions in the amount of the purchase price, to the successful bidder.

 

Closing: The balance of the purchase price is due at closing which will take place within 30 days of presentation of title policy. Closings held for Purchasers at Title Co. office are at Purchasers expense.

 

Possession: Immediate

 

Real Estate Taxes: Taxes to be prorated as paid in advance.

 

Acreage: All parcels, dimensions and boundaries are approximate and have been estimated based on legal descriptions, tax records and/or aerial photos.

 

Survey: A new legal survey will be made where these is no existing legal description or where new boundaries are created by parcel division in this auction. Survey will be paid for by the Sellers. Combination purchases will receive perimeter survey only.

 

Agency: Chuck Cryderman and Associates L.L.C., Gary M. Berry - Auctioneers and Elmlands Realty Co. and it’s representatives are Exclusive Agents of the Sellers.

 

Disclaimer and Absence of Warranties: All information contained in this brochure and all related materials are subject to the Terms and Conditions outlined in the Purchase Agreement. The property is being sold on an “AS IS/WHERE IS” basis and no warranty or representation either expressed or implied concerning the property is made by the Sellers, the Auction Co. or the Broker. All sketches and dimensions in the brochure are approximate. Each potential bidder is responsible for conducting his/her own independent inspections, investigations, inquiries and due diligence concerning the property. The information contained in this the advertising material is subject to verification by all parties relying on it. No liability for it’s accuracy, errors or omission is assumed by the Sellers or the Auction Co. Conduct of the auction and increments of bidding are at the discretion of the Auctioneer. The Trustee/Seller and Selling Agents reserve the right to preclude any person from bidding if there are any questions to such person’s credentials.

 

Lead Based Paint: Building may have been constructed before 1978 when lead based paint was still being used. Potential bidders on these properties will have a period of 10 days prior to the auction to have premises tested at their expense, if they desire.
 

Announcements:  Any announcements made the day of sale take precedence over printed material or any other oral statement made.
 

Inspection of Real Estate:  Sunday, June 4  from 2 PM - 4 PM.
